Terms of service
Terms governing use of the Footstep AI website, the REST API, the MCP server, and the predict spatial probability model.

1. About these terms
These Terms of Service ("Terms") govern your use of the Footstep AI Ltd marketing site at footstep.ai, the customer console at console.footstep.ai, the REST API at api.footstep.ai, and the hosted MCP server at mcp.footstep.ai (together, the "Service").
By creating an account, generating an API key, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
The Service is provided for business, professional, and research use only. You must be at least 18 years old and authorised to enter into these Terms on behalf of any organisation you represent.
3. Accounts and API keys
You are responsible for maintaining the confidentiality of your API keys and for all activity that occurs under them. Do not share keys with unauthorised parties or expose them in client-side code, mobile apps, or any context where a user could inspect network traffic.
We may rotate, suspend, or revoke keys at our sole discretion if we suspect compromise, abuse, or breach of these Terms.
4. Acceptable use
You will not:
- use the Service for any unlawful purpose or in violation of any applicable law
- reverse-engineer, decompile, or attempt to derive the source of the Service
- circumvent rate limits, billing, or access controls
- use the Service to build a competing geocoding, routing, or spatial probability product
- use the Service to track, surveil, profile, or harass individuals without lawful basis
- resell or sublicense the Service without a written agreement with us
5. Predict: restricted access and use
Critical: predict is not general access
Separate signed agreement required. The Predict tool and the underlying probabilistic spatial model are gated behind a separate signed written agreement with Footstep AI Ltd. These Terms grant no right of access to Predict by themselves. We reserve the right to refuse, restrict, or revoke Predict access at any time without cause.
Research Preview. Predict is and remains a Research Preview model. The model is under active development; inputs, outputs, behaviour, and availability may change without prior notice. Outputs may be biased, incomplete, or wrong.
Decision support, never a decision-maker. Predict outputs are probability priors generated by a statistical model. They must never be used as a substitute for expert human judgment, established response protocols, formal search planning, training, regulatory obligations, or any duty-of-care obligation. Customer remains the sole decision-maker and operator. Footstep AI Ltd is not the source of truth for any decision, response, or outcome.
Excluded from warranties and liability. Predict outputs are excluded from any warranty, condition, or representation, express or implied. Predict outputs are excluded from the limitation of liability cap in section 11 below and instead carry a complete exclusion of liability, both direct and indirect, to the maximum extent permitted by law. Customer carries all risk arising from any use of Predict.
Required acknowledgement. By using Predict, Customer acknowledges the limitations above and agrees that Footstep AI Ltd accepts no liability whatsoever for outcomes, decisions, actions, or omissions arising from operational reliance on Predict outputs.
6. Use of AI components
Where the Service includes AI features (including but not limited to Predict, address parsing, and natural-language query routing), Customer is the deployer and Footstep AI Ltd is the provider.
- Customer is responsible for assessing whether use of any AI feature is appropriate for Customer's context, and for conformity with all applicable law, regulation, and industry-specific guidance, including (without limitation) the EU AI Act, UK AI safety guidance, the UK GDPR and Data Protection Act 2018, and sector-specific rules for emergency-services, public-safety, healthcare, financial- services, and other regulated workloads.
- Customer is responsible for risk assessment, conformity documentation, transparency disclosures to end users, and any human-in-the-loop oversight required by applicable law.
- Footstep AI Ltd makes no representation that any AI feature meets any specific regulatory standard, certification, or sector-specific obligation. Customer must not represent otherwise to its users, regulators, or third parties.
- Customer agrees not to deploy any AI feature in a high-risk context (as defined by applicable law) without first independently verifying its suitability and securing any required regulatory approval.
7. Pricing and billing
Usage is billed per successful API call at the rates published on the pricing page. Failed responses (4xx and 5xx) are not billed. Pre-paid balances do not expire. We may change pricing on at least 30 days' notice; existing balances are honoured at the rate at which they were purchased.
8. Service availability and SLAs
We aim for above 99.9% availability across the REST API and MCP server but do not warrant any specific level of availability unless agreed in writing under an enterprise plan. We may perform scheduled maintenance and emergency maintenance with reasonable notice where possible.
9. Intellectual property
All intellectual property rights in the Service (including software, models, documentation, and marketing materials) belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service strictly in accordance with these Terms.
Output data returned to you in response to your API requests is yours to use within the bounds of these Terms. You retain ownership of your input data.
10. Confidentiality and data
We treat the contents of your API requests and responses as confidential. We do not use your payloads to train machine- learning models or share them with third parties beyond what is necessary to operate the Service. Privacy and data-protection obligations are described in our Privacy Policy.
11. Warranties and liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
Our aggregate liability under these Terms is limited to the greater of (a) the fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) GBP 100. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, fraud or death and personal injury caused by negligence).
12. Indemnity
You agree to indemnify and hold us harmless from any third-party claim arising from your use of the Service in breach of these Terms, including any claim related to your operational use of predict outputs.
13. Termination
You may close your account at any time. We may suspend or terminate your access for breach of these Terms, suspected abuse, or where required by law. On termination, your right to use the Service ends and unused pre-paid balance over GBP 50 is refundable on request.
14. Changes
We may revise these Terms. Material changes will be communicated by email or in-product notification. Continued use of the Service after the effective date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
